1. Introduction and Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and purchase of digital products sold by Regulate Mind and Body, operated by Karlye Williamson ("we", "us", "our") through — SamCart at regulatemindandbody.com.au and associated checkout pages.

By completing a purchase or accessing any of our digital products, you ("you", "your", "the buyer") confirm that you have read, understood, and agreed to be bound by these Terms in their entirety. If you do not agree to these Terms, do not proceed with your purchase.

These Terms form a legally binding agreement between you and Regulate Mind and Body.

3. Our Digital Products

3.1 Product descriptions

We sell digital educational products, including but not limited to:

– Overthinking Reset Kit (PDF handbook + videos)

– The Seated Reset videos bundle and Ebook

– Wired but Tired — Nervous system sleep guide + Videos

– Reset Everything — Complete regulation bundle -Regulating Nervous System Pathways — Online program (video series and resources)

– Any other digital resources, guides, workbooks, diagrams, or video content we offer from time to time.

3.2 Educational nature of content

All products sold by Regulate Mind and Body are educational and informational in nature. They are designed to support general wellbeing and nervous system literacy. They do not constitute occupational therapy services, clinical treatment, mental health treatment, medical advice, or any regulated health service.

The content is prepared by a registered occupational therapist drawing on evidence-informed practice frameworks. However, purchasing and using these products does not create a therapeutic or professional relationship between you and Karlye Williamson.

3.3 Product delivery

Upon successful payment, you will receive access to your digital product/s via email link, download link, or online platform access, as applicable to the product purchased. Delivery is typically instant or within a few minutes of payment confirmation.

It is your responsibility to provide a valid and accessible email address at checkout. We are not responsible for non-delivery resulting from an incorrect email address or email filtering (spam folders).

4. Pricing and Payment

4.1 Prices

All prices are displayed in Australian Dollars (AUD) unless otherwise stated. Prices are inclusive of any applicable Goods and Services Tax (GST).

We reserve the right to change product prices at any time. The price displayed at the time of your purchase is the price that applies to your order.

4.2 Payment processing

Payments are processed securely through SamCart. We do not store your credit card or payment details. All transactions are subject to the terms and conditions of the relevant payment processor.

By completing a purchase, you authorise the charge of the stated amount to your nominated payment method.

4.3 Failed payments

If payment fails, your order will not be fulfilled and you will not receive access to the product. Please contact us at karlye@regulatemindandbody.com.au if you experience payment difficulties.

5. Refund and Returns Policy

5.1 No change-of-mind refunds

Because our products are digital and delivered with immediate access upon purchase, we do not offer refunds for change of mind, buyer's remorse, or circumstances where you have accessed or downloaded the product.

We encourage you to read all product descriptions carefully before purchasing to ensure the product is suitable for your needs.

5.2 Australian Consumer Law

Our refund policy does not exclude, restrict, or modify any rights you have under the Australian Consumer Law (ACL) (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Your statutory consumer guarantees cannot be excluded.

If a product:

– does not match its description as advertised

– is not of acceptable quality

– is not fit for the purpose for which it was described or represented

5.3 Technical issues

If you are unable to access your product due to a technical issue on our end, please contact us within 7 days of purchase and we will make reasonable efforts to resolve the issue or, if we are unable to do so, provide an appropriate remedy.

HOW TO REQUEST A REMEDY: Email karlye@regulatemindandbody.com.au with your order number, the product purchased,

the date of purchase, and a description of the issue. We aim to respond within 2 business days.

6. Health and Wellness Disclaimer — Not Medical or Clinical Advice

IMPORTANT: Please read this section carefully before purchasing.

The content in our digital products is educational and informational only. It is not a substitute

6.1 Educational content only

Our products contain educational content about nervous system regulation, Polyvagal Theory, somatic practices, and general wellbeing strategies. This content is intended to support self-directed learning and general wellbeing — not to diagnose, treat, cure, or prevent any medical or mental health condition.

6.2 No therapeutic relationship

Purchasing or using our digital products does not create a therapeutic, clinical, or professional relationship between you and Karlye Williamson or Regulate Mind and Body. The content in our products does not constitute occupational therapy services and is not subject to occupational therapy professional obligations.

6.3 Individual results and suitability

The strategies, tools, and practices described in our products may not be suitable for everyone. Individual results will vary. We make no guarantee or representation that any particular outcome will result from using the content in our products.

6.4 Supplement and product references

Where our products refer to dietary supplements, natural health products, or biohacks (including but not limited to magnesium, L-theanine, or GABA), this is for educational and general informational purposes only. It is not a recommendation that you take any specific supplement.

7. Intellectual Property Rights

7.1 Ownership

All content in our digital products — including but not limited to text, graphics, diagrams, frameworks, videos, audio, worksheets, branding, the Polyvagal Ladder diagram, the Arousal Continuum diagram, the Safety Anchors worksheet, the 3 Ways to Reset framework, and all associated materials — is the intellectual property of Karlye Williamson / Regulate Mind and Body, unless otherwise stated.

Our content is protected by Australian and international copyright law. Unauthorised use, reproduction, distribution, or modification of our content is prohibited.

7.2 Licence to use

Upon purchase, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the digital product/s for your own personal, non-commercial use only.

This licence does not permit you to:

– Copy, reproduce, or distribute the product or any part of it to others

– Share login credentials, download links, or access details with anyone else

– Use the content in educational, clinical, or professional settings without written permission

– Resell, sub-licence, or otherwise commercially exploit the product

– Remove or alter any copyright, trademark, or proprietary notices

– Create derivative works based on our content without written permission

7.3 Practitioner use

If you are an allied health professional, educator, or practitioner and wish to use our frameworks, diagrams, or content in your professional practice, group settings, or training, you must obtain written permission from us prior to doing so. 7.4 Attribution

To the maximum extent permitted by law, Regulate Mind and Body and Karlye Williamson shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or in connection with your purchase or use of our digital products, including but not limited to:

– Loss of data or access

– Personal injury or health outcomes arising from use of information in our products

– Technical failures, delivery failures, or platform outages beyond our reasonable control

– Your reliance on any information, strategy, or tool contained in our products

9.2 ACL liability not excluded

Nothing in these Terms is intended to exclude, restrict, or modify any liability that cannot be excluded under the Australian Consumer Law or any other applicable law.

9.3 Maximum liability

Where liability cannot be excluded by law, our total liability to you in relation to any claim arising from these Terms or your purchase is limited to the amount you paid for the relevant product.

10. Privacy

We collect and handle your personal information (including name, email address, and payment information) in accordance with our Privacy Policy, available at https://regulatemindandbody.com.au/policies/privacy-policy and the Privacy Act 1988 (Cth).

By purchasing from us, you consent to the collection, use, and storage of your personal information as described in our Privacy Policy. Your payment details are processed by our payment processor and are not stored by us.

We may use your email address to send you order confirmations, product delivery, and (with your consent) marketing communications. You may unsubscribe from marketing emails at any time using the link in our emails.
